Constitutional Court: Access ban on news shared on social media is violation of press freedom and freedom of expression

The Constitutional Court (AYM) decided that the access ban brought against the news shared by Republican People’s Party (CHP) 26th Session Istanbul MP and journalist Barış Yarkadaş on Gerçek Gündem news website was a violation of freedom of expression and press freedom.

 

A news article was published on former Radikal Daily’s July 27, 2014 issue and Yarkadaş has shared this news article on the social media from Gerçek Gündem news website with the comments, “Parallel Judge: I Have Signature for Tapings” and “Interesting confession by July 22 investigation judge.” Istanbul 6th Criminal Judicature of Peace brought an access ban on the post due to the violation of personal rights of the judge in question.

 

The reasoned verdict stated that the Constitutional Court does not deem the reason of the ban decree relevant and sufficient, saying, “The access ban decree against a media content as a result of a non contradictory case is only possible in cases when intervention against personal rights and the unlawfulness is obvious and the damage must be recovered rapidly.”
