Constitutional Court finds torture photographs “baseless”

The Constitutional Court (AYM) denied the application made by Ömer Şimşek, who was detained in 2016 in Bismil district of Diyarbakır and was tortured, due to being “baseless” despite photographs of Şimşek, depicting the torture. The high court decided that no violation has taken place that is within the responsibilities of the government.

 

Specialised sergeant Erdem Ünal had lost his life on June 28, 2016 following an armed attack in the district; and Ömer Şimşek was going back from paying his condolences. The vehicle Şimşek, Yusuf Başkan and Sadrettin Bilir were in was stopped by special teams and started to beat three people they took out of the vehicle. The three people were beaten until they were unconscious and they continued to face torture at the District Security Directorate they were taken to. There were bruises, scars and broken bones in their heads, faces and vital organs due to the heavy torture they were exposed to. 

 

Following the claims of the lawyers of the three people, who were later taken to Diyarbakır Provincial Security Directorate, their photographs were taken in accordance with the order from the investigation prosecutor. The citizens were sent to Diyarbakır Institute of Forensic Medicine (ATK) in order for the identification of their scars and bruises due to the torture; and they weren’t examined there due to the absence of a physician. Şimşek and his two friends couldn’t receive a report and they were arrested by the court they were taken to, with the allegation of “establishing, managing an illegal organization and premeditated killing.” The three names remained under arrest for a year and were acquitted in the lawsuit they were on trial at Diyarbakır 4th Assize Court in 2019.
